These terms govern your use of VividSwim, operated by RSB Applied Ltd (RSB Applied). Contact developers@rsbapplied.com with questions. Please read these terms and our Privacy notice before using the service.

The service

VividSwim lets you explore 3D swim-event replays, recordings, routes and optional character features. Some features are experimental, simulated or unavailable in a particular environment. Localhost, staging and production have separate accounts, data and settings. Staging is a testing environment and may be interrupted or reset; keep your own original files.

Accounts and access

Provide accurate account information, protect your sign-in access and use only accounts and events you are authorised to access. Tell us promptly if you suspect misuse. Google sign-in is subject to Google’s own terms and availability. You must be able to enter an agreement under the law applicable to you; where parental permission is required, obtain it before using the service.

Your content and permissions

You retain your rights in uploaded recordings, photos, models and other content. You give RSB Applied permission to host, copy, process, convert and display that content as needed to provide the features and sharing you request. That permission does not transfer ownership and continues only as needed for those purposes, including applicable retention and recovery described in our Privacy notice.

Upload content only if you have the rights and authority to do so, including appropriate permissions for other people’s photographs, names, location tracks and recordings. Respect copyright, privacy and event rules. Event owners are responsible for their invitations, publication choices and approved contributions. Viewers may retain copies of content they can access; revoking a link cannot recall copies already obtained.

Acceptable use

Do not access another person’s account without permission, bypass access controls, interfere with the service, upload malware, infringe intellectual-property rights, harass people or use the service unlawfully. Do not upload sensitive personal information without appropriate authority. We may restrict access or remove content where reasonably necessary to address abuse, security, legal requirements or breaches of these terms. Contact us if you believe a restriction or removal is mistaken.

Replay accuracy and water safety

GPS, timing, terrain, avatars and animation may be incomplete, estimated or simulated. A replay is not an official race result, navigation chart, medical assessment or a verified analysis of swimming technique. Do not rely on VividSwim to plan safe entry, judge water depth, navigate or make emergency decisions. Follow organisers’ instructions and appropriate safety advice.

Fees and third-party features

Membership prices or generation options shown as proposed, planned or expressions of interest are not purchases or guarantees of availability. Any paid feature must present its price and applicable payment, renewal and cancellation terms before you commit. These terms do not authorise a charge. Third-party sign-in, maps and generation services have their own availability and terms.

Availability, ending use and responsibility

We aim to provide a useful service but cannot promise uninterrupted availability or error-free replays. Keep copies of important originals. You can stop using VividSwim and request account removal through Personal data controls or by contacting us. Shared content and recovery records are handled as explained in the Privacy notice.

We are responsible for losses to the extent required by applicable law. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any liability or consumer rights that cannot lawfully be excluded. We do not guarantee compatibility with every device or third-party service.

Changes and complaints

We may update these terms as features change. We will identify the revision date and provide notice of material changes where appropriate; changes do not remove rights you already have under applicable law.
